PURPOSE

These General Terms and Conditions govern the purchase of handcrafted ceramic products offered on this website.

PRODUCTS

The products on offer consist of handcrafted ceramic pieces.
The photographs and images shown on the website are for illustrative purposes only and serve as a reference for the design, finish and style of the pieces on offer. As all products are handcrafted, each piece is unique and may vary slightly in dimensions, shape, colour, shade, texture, glazing or finish from the images published. These differences are inherent to the handcrafted manufacturing process and do not constitute defects, non-conformity or grounds for a complaint, provided that the item delivered substantially meets the essential characteristics of the product purchased.

PURCHASING PROCESS

The buyer may place their order via the methods provided on the website.
Once the order has been received, the seller will confirm its acceptance by email or via WhatsApp.
Placing the order constitutes a commitment to purchase on the part of the buyer in accordance with these terms and conditions.

PRICE

All prices shown on the website are in euros (€) and include the applicable taxes, unless expressly stated otherwise.
The applicable price will be the one in force at the time the order is placed.

PAYMENT METHOD

The buyer may choose from the following payment methods:

• Bank transfer prior to delivery of the product.
• Cash payment upon collection of the item from the workshop.

Delivery of the product will be subject to full payment of the relevant amount.

DELIVERY AND COLLECTION

We do not offer home delivery.
Purchased items must be collected in person by the buyer from the workshop located at Avenida del Cister 45, Unit 1 Left, 07010 Secar de la Real, once the buyer has been notified that the order is complete and ready for collection.
The buyer will have a reasonable period of time to collect the item once they have been informed that it is available.

RIGHT OF WITHDRAWAL

In accordance with Article 103(c) of the Consolidated Text of the General Law for the Protection of Consumers and Users, the right of withdrawal shall not apply to orders for bespoke ceramic items, as these are goods manufactured to the consumer’s specifications or clearly personalised.
Consequently, once the order has been confirmed and production has begun, the buyer may not cancel the purchase or request a return; however, they may withdraw from the contract within the first 24 hours of placing their order.

LEGAL WARRANTY AND CONFORMITY

The seller shall be liable to the consumer for any lack of conformity existing at the time of delivery of the product, in accordance with current consumer and user legislation.
Minor variations inherent to the artisanal production process, as described in clause 3, shall not be considered defects.

COMPLAINTS

The purchaser may address any enquiries, issues or complaints using the contact details set out in these terms and conditions under the ‘Ownership’ section.
The parties undertake to endeavour, in good faith, to resolve any dispute that may arise in relation to the interpretation or performance of these terms and conditions.

LANGUAGES

The Procurement Policy and the Contract are available for consultation in Spanish and English.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions shall be governed by Spanish law.
In the event of any conflict, dispute or disagreement between the parties, they expressly agree to submit to the courts and tribunals of Palma de Mallorca, waiving any other jurisdiction to which they might be entitled.
